1. Who we are
Whispering AI ("Whispering AI," "we," "us," or "our") operates this website and related marketing, communications, and business development activities. This Privacy Policy describes how we collect, use, disclose, and safeguard information when you visit our site, request information, attend events, or otherwise interact with us online or offline in connection with these activities.
If you engage us under a separate services agreement, additional or different terms may apply to personal data processed as part of that engagement. Where there is a conflict, the agreement governs for that engagement.
2. Information we collect
We may collect the following categories of information:
- Contact and identity data. Name, email address, phone number, company name, job title, time zone, and similar details you provide when you contact us, subscribe to updates, register for webinars, download resources, or book meetings.
- Communications content. Messages you send us (including email and in-app or form messages), meeting notes you authorize us to retain, and feedback you provide.
- Marketing and engagement data. Preferences, campaign interactions, event attendance, and responses to surveys where you choose to participate.
- Technical and usage data. IP address, device type, browser type, operating system, general location derived from IP, pages viewed, referring URLs, and timestamps. We collect this through cookies and similar technologies where enabled (see Section 6).
- Client and project data (where applicable). If you become a client, we may process business contact information and materials you share for scoping, delivery, and support. Handling of confidential or regulated data should be covered by your agreement with us and any applicable data processing addendum.
We do not knowingly collect sensitive categories of personal information through this marketing website (such as health information, government identifiers, or precise geolocation) unless you voluntarily submit them to us in a specific context and we have a lawful basis to process them.
3. How we use information
We use personal information for purposes such as:
- Responding to inquiries and scheduling conversations;
- Operating, maintaining, and improving our website and user experience;
- Sending transactional messages (for example, confirmations) and, where permitted, marketing communications you can opt out of;
- Analyzing aggregate or de-identified usage to understand effectiveness of content and campaigns;
- Protecting security, preventing fraud, and enforcing our terms;
- Complying with law, regulatory requests, and valid legal process;
- Other purposes disclosed at collection or with your consent.
We do not sell your personal information in the traditional sense of selling lists for money. If we use advertising or analytics technologies that could constitute "sale" or "sharing" under U.S. state laws, we will provide appropriate notices and choices as required.
4. Legal bases (EEA, UK, and similar regions)
Where the GDPR or similar laws apply, we rely on one or more of the following: your consent (for example, marketing cookies or optional emails where required); performance of a contract or steps prior to entering a contract; legitimate interests that are not overridden by your rights (for example, website security, limited business development outreach to corporate contacts, and product improvement based on aggregated analytics); and legal obligation.
5. How we share information
We may share personal information with service providers that assist us under contract, for example: hosting, email delivery, customer relationship management, analytics, calendar scheduling, and security tools. They may process data only on our instructions and are expected to implement appropriate safeguards.
We may disclose information if required by law, to respond to lawful requests by public authorities, or to protect the rights, safety, and security of Whispering AI, our users, or others.
If we are involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to standard confidentiality arrangements.
6. Cookies and similar technologies
We and our partners may use cookies, local storage, pixels, and similar technologies for essential site operation, preferences, analytics, and (where applicable) advertising measurement. You can control cookies through your browser settings. Blocking certain cookies may affect site functionality.
Where required, we will obtain consent before using non-essential cookies and provide a way to update preferences.
7. Retention
We retain personal information for as long as needed to fulfill the purposes described in this policy, unless a longer period is required or permitted by law. Criteria include the nature of the relationship, whether you remain an active prospect or client, legal or regulatory obligations, and dispute resolution.
8. Security
We implement administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure; we encourage you to use strong passwords and protect your accounts.
9. International transfers
We may process and store information in the United States and other countries where we or our service providers operate. If we transfer personal data from the EEA, UK, or Switzerland, we use appropriate safeguards such as standard contractual clauses where required.
10. Your rights and choices
Depending on your location, you may have rights to access, correct, delete, or restrict processing of your personal information, to object to certain processing, to data portability, and to withdraw consent where processing is based on consent. You may also have the right to lodge a complaint with a supervisory authority.
To exercise rights, contact us using the information in Section 14. We may need to verify your request. We will not discriminate against you for exercising privacy rights granted by applicable law.
11. California residents
If the California Consumer Privacy Act (CCPA) or California Privacy Rights Act (CPRA) applies, California residents may have additional rights, including to know categories of personal information collected, the purposes of collection, and in some cases to request deletion or correction. We do not use or disclose sensitive personal information for inferring characteristics in a manner that would trigger CPRA limits beyond permitted business purposes. You may designate an authorized agent to submit requests where permitted by law.
12. Children's privacy
Our services are directed to businesses and adults. We do not knowingly collect personal information from children under 16. If you believe we have collected information from a child, please contact us and we will take appropriate steps to delete it.
13. Changes to this policy
We may update this Privacy Policy from time to time. We will post the revised version on this page and update the "Last updated" date. If changes are material, we will provide additional notice as appropriate.
